By using GambitCoach (the "Service"), operated by the provider identified in the Imprint, you agree to these Terms of Service. If you do not agree, do not use the Service.
GambitCoach is a chess analysis tool that fetches your publicly visible
games from chess.com, runs Stockfish evaluation against them, and presents
move-by-move feedback, openings statistics, training puzzles, and related
features. The Service is offered as a web application at
gambitcoach.com.
To the maximum extent permitted by applicable law, the Service is provided "AS IS" and "AS AVAILABLE" without warranty of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Service will be error-free, uninterrupted, or that analysis results will be accurate. Mandatory statutory warranty rights for consumers under EU and German law (in particular §§ 327d ff. BGB) are not affected.
We are liable without limitation for intent and gross negligence, for injury to life, body or health, under the German Product Liability Act (Produkthaftungsgesetz), and for breaches of guarantees we have given.
For ordinary negligence, we are liable only for the breach of essential contractual duties ("Kardinalpflichten") - duties whose fulfilment makes the proper performance of the contract possible in the first place and whose fulfilment the contractual partner regularly relies on - and only for the typical, foreseeable damage.
All other liability for ordinary negligence is excluded. The Service is not designed to make irreversible real-world decisions; we are not liable for losses incurred from acting on engine analysis (e.g. tournament performance).
GambitCoach offers three tiers: a Free tier with basic functionality, a paid Gold tier, and a paid Premium tier with additional features (higher daily game-review quotas, full openings and courses libraries, advanced endgame training, personal puzzles and endgames). Current prices, billing cycles, and the full feature breakdown are listed on our Pricing page and form part of these Terms by reference.
Paid subscriptions are billed and processed by Paddle.com Market Limited acting as the Merchant of Record; Paddle handles payment, invoicing, applicable VAT, and refund processing on our behalf. Subscriptions renew automatically at the end of each billing cycle (monthly or annual) until cancelled. You can cancel at any time from your account page; cancellation takes effect at the end of the current billing cycle. See our Refund Policy for details on refunds and the 14-day right of withdrawal.
If you are a consumer within the meaning of § 13 BGB and resident in the European Union, you have the right to withdraw from a paid subscription contract within 14 days without giving any reason (§ 355 BGB, EU Directive 2011/83/EU).
The withdrawal period begins on the day the contract is concluded. To exercise the right of withdrawal, you must inform us (support@gambitcoach.com) of your decision by an unambiguous statement (e.g. a letter sent by post or email). You may use the model withdrawal form provided in Annex I of the EU Consumer Rights Directive, but it is not obligatory. To meet the deadline, it is sufficient to send the communication concerning the exercise of the right of withdrawal before the withdrawal period has expired.
Early start of service / loss of withdrawal right. If you explicitly request the Service to start during the 14-day withdrawal period and acknowledge that you will lose your right of withdrawal once the Service has been fully performed, the right of withdrawal expires upon full performance. For a digital service that is delivered continuously (such as a monthly subscription), if you cancel during the 14-day period you may be charged a pro-rata fee for the days the Service was available to you.
Effects of withdrawal: if you validly withdraw, we will refund all payments received from you within 14 days, using the same means of payment you used for the original transaction unless we expressly agree otherwise; in no case will you be charged any fees for this refund. Because Paddle acts as the Merchant of Record, refunds are processed by Paddle; see the Refund Policy for the step-by-step procedure and how to contact us.
We may suspend or terminate access for users who materially breach these acceptable-use rules.
The GambitCoach application source code is licensed under the MIT License. Stockfish is used under the GPL-3.0 license; the corresponding source is linked from the in-app "About" section. Chess piece artwork and other third-party assets are used under their respective open-source licenses; see THIRD_PARTY.md for the full attribution list.
The GambitCoach name and logo are the property of the operator named in the Imprint. Chess.com, Lichess, and Stockfish are trademarks of their respective owners and are referenced here for descriptive purposes only.
These Terms and any non-contractual obligations arising out of or in connection with them are governed by the laws of the Federal Republic of Germany, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). If you are a consumer with habitual residence in another EU member state, the mandatory consumer-protection provisions of that state's law remain applicable.
The non-exclusive place of jurisdiction for disputes with merchants, legal entities under public law, or special funds under public law is the operator's registered seat (see Imprint). For consumers, the statutory venue rules apply.
The European Commission provides a platform for online dispute resolution (OS), available at ec.europa.eu/consumers/odr. Our email address for ODR purposes is support@gambitcoach.com. We are not legally obliged and not generally willing to participate in dispute-resolution proceedings before a consumer arbitration board (Verbraucherschlichtungsstelle) under the Verbraucherstreitbeilegungsgesetz (VSBG).
We may update these Terms from time to time. The "Last updated" date at the top of this page reflects the most recent revision. Material changes to paid-plan terms will be communicated in-app at least 30 days before they take effect; you may cancel before the change takes effect.
If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions remain in full force and effect.
